Hi Migs,

Naturally, kinabahan ako at napabalikwas.

Yung iba, nagtatakip ng mukha with a towel.

Ibinigay ko ang aking tunay na pangalan, edad, address, trabaho, at school where I graduated from.

I’m not sure kung tama ang spelling.

This time, ay galit sila.

I was shocked when I read this.

Disrespectful and authoritative policemen. More fun in the Philippines.

Because our policemen are poorly armed and scarcely compensated, they use fear and threats, instead of guns and knowledge of the law, to act to their advantage.

There is an unverified report that CB was raided for 2nd time in less than two weeks. If this report is true…then it is too much already. A complaint should be filed against the raiders for their illegal raids.

    EQUALITY AND JUSTICE

Last 9 February 2012, Gen. Bartolome said that as part of the PNP’s strict adherence to human rights, all members of the 140,000-strong police force are required to recite the New Miranda Doctrine when making arrest and uphold Republic Act 9745 or the Anti-Torture Law.

As a rule, no arrest may be made without a warrant of arrest. The exceptions [also referred to as warrantless arrests] under the Revised Rules on Criminal Procedure (Rule 113, Sec. 5) are arrests made by a peace officer or a private person:

    (a) When, in his presence, the person to be arrested has committed, is actually committing, or is attempting to commit an offense;

    (b) When an offence has just been committed and he has probable cause to believe based on personal knowledge of facts or circumstances that the person to be arrested has committed it; and

    (c) When the person to be arrested is a prisoner who has escaped from a penal establishment or place where he is serving final judgment or is temporarily confined while his case is pending, or has escaped while being transferred from one confinement to another.

The right against deprivation of liberty is guaranteed by no less than the Constitution, which states that “[n]o person shall be deprived of life, liberty or property without due process of law xxx” (Article 3, Section 1) and that “[n]o search warrant or warrant of arrest shall issue except upon probable cause to be determined personally by the judge after examination under oath or affirmation of the complainant and the witnesses he may produce, and particularly describing the place to be searched and the persons or things to be seized.” (Art. 3, Sec.2) This right has been characterized by the Supreme Court as “a most basic and fundamental” right that has been “often violated and so deserving of full protection”.

Whew! What an experience that must have been. I was a CB regular back when it was still in Roxas blvd. Those were the days! I went once when they moved to that place near the Pasay City Hall, and never came back. Somehow it was different, there was something missing.

Anyway, enough of the sentimental memories. This raid have illegal plastered all over it. These rogue policemen target gays because they have the money, and they raided CB because it was discreet. Discreet gays would go to discreet places. And damn, they would be scared as hell when they are in danger of getting exposed.

I am a closeted gay, and being exposed is a constant fear that I have to live with. And this is a vulnerability that thugs like the SPD policemen will always take advantage of. I wish it is a better world out there, but it is not. Not yet anyway. But times will change, and we will have our place in the sun someday. It will not be easy, we will have to fight for it. Someday, I will fight my own personal battles and be myself. I deserve to be happy, we all do.

  29. caloy said on 22-04-2012

is that true that 70+ people were there on the night of the raid? That must be a big night for CB then! I don’t recall a night when there were patrons more than 40-50 even on a particular hour there..

This is an assault. As part of the LBTG community, we should escalate this. Their act is an violation of human rights and a violation of Anti-Discrimination Act of 2011

If their pissed of M2M sex, I would like to raise the same question, are they clean enough to have sex with other women out of their marriage? It is the same thing.

It is not a public scandal, thus being done to a legitimate place.

The last time I’ve been to Club Bath was last January (before I went on a sabbatical leave in NYC). Maybe it is by chance, coincidence, or a stroke of luck that my plans of going there on April 12 didn’t materialized. Lo and behold, there’s a raid! I can’t believe this!

A recent conversation with a good friend (he holds a respectable position in Southern Police District (which covers Pasay and Paranaque) ended in an optimistic tone on my part. I learned that it was an “unannounced” (surprise or unscheduled on my police-friend’s part, I don’t know, I have to coax him more to “squeeze the juice and let it all out ’til it hurts”) raid and he wasn’t there. He was divisive over it since there’s no arrest or search warrant against the CB owner, and the “basic human rights, i.e., Miranda Law, of the arrested persons were violated to the fullest”.

As long as the arrested persons or the CB management (which I doubt in this juncture, since it will definitely affect the business) are willing to file appropriate charges against the “raid team,” I will help in one way or another. My heart goes to them: the innocent patrons whose “intimate moments of sexual pleasure that were shared in a private space” were harangued,” and will definitely leave an indelible mark on their life experiences (sexual, friendship or otherwise).

I received this Note from Club Bath Management.
I hope this will enlighten the gay community:

The Gay Bathhouse: a respectful and legal Establishment in the Philippines

This article is created specifically to create thorough understanding of what a Gay Bathhouse is. It aims to give enlightenment to Gays and Heterosexuals to create harmony and respect while upholding Human Rights and Dignity.

    Philippines First Gay Bathhouse

The first ever Gay Bathhouse in the Philippines was created in 1978. The concept was created to give an opportunity for the Gay community to express themselves freely amidst the Religious and Traditional barriers that discriminated them in society.

Club Bath was the name of the first Bathhouse in the Philippines. It was actually the first Gay Bathhouse in Asia. Many respected Gay Bathhouses in USA and Europe served as inspirations to its opening.

It’s opening marked a shift in modern thinking and empowerment for the Filipino people.

The Gay community celebrated at last with the birth of an establishment that served their needs without discriminating the true heart expressions.

Club Bath was among the first to support the promotions of safe sex. It was supported by the Elizabeth Taylor AIDS Foundation (ETAF). Through it’s tie-up with ETAF, the Club Bath establishment conducted several campaigns to promote the use of contraceptives/condoms and uphold freedom of sexuality from the mid-80’s onwards.

The difference between a Gay Bathhouse and an illegal Gay Bar and illegal Sex Clubs in the Philippines

People must be able to differentiate illegal business operations and a legal respected Bathhouse. Confusion creates problems of misunderstanding by authorities and the society as a whole.

A legal gay bathhouse in the Philippines is a place where the Gay community members can mingle and meet each other. Inside the premises they can have sex with each other should it be consensual. Just like a legal hotel, heterosexual motel or a heterosexual swingers club, a gay bathhouse provides room service to those who want to be intimate with each other.

There should be no illegal activities in a real Gay Bathhouse such as public viewing of X-Rated films, Prostitution,Live Shows, Alcohol, Drugs, rape, harassment or unsolicited sex.

Establishment’s that operate with prostitution and other illegal services are not Bathhouses but Brothels or illegal sex clubs. Thus the community must know the difference between a Bathhouse and illegal sex clubs or illegal brothels. They must be able to decide consciously what type of establishment best suites their character.

The community must be aware of places that express illegal activities and must be able to patronize them with the best judgment.

    Vic,
Thanks a lot for sharing this with us. It’s troubling to know that until now PLUs (people like us) continue to be victims of police brutalities and some people still find “our acts” despicable. Ours is a marginalized world. Despite the clamor for equality and freedom, we remain hopeless, victims, and more often than not, exploited. While it may take awhile for your trauma to banish, I personally believe that the authorities have no right to raid the place since it is an establishment exclusively for members and it is not a haven for prostitution, drugs, and other illegal activities.

“Non-commercial, homosexual relations between consenting adults in private are not a crime. Although sexual conduct or affection that occurs in public may be subject to the “grave scandal” prohibition in Article 200 of the Revised Penal Code. The universal age of consent is set at 12, but contacts with minors (under 18) are an offense if the minor consents to the act for money, gain or any other remuneration or as the result of an influence of any adult person.”

CB is a private establishment. They don’t even advertise the place. It is only known to PLUs.

Why target such discreet place when there are other more conspicuous havens for flesh markets? Obviously, policemen are playing on the vulnerabilities of our kind. Another thing, CB is within the jurisdiction of Pasay and Paranaque has no right to step into the affairs of its neighbors.

To those who have submitted discriminatory comments on your post, please do not judge us. Look upon yourself before you throw stones unto others.

    Migz,
Can you organize a briefing re-emphasizing the LGBT rights? I’m more than willing to spare some amount for the gathering. Let’s shed some light on why such brutalities never seem to end. Let’s all stand to assert our rights.

    Vic,
    Hugs…take care always.

  38. Inigo said on 20-04-2012

Personally, I think, we gay people are the target of these ruthless policemen because we are the marginalized group with money. Maabilidad tayong kumita ng pera. Lahat na pwede nating gawin ay gagawin natin para lang kumita ng pera, as long as it is legal, to provide for our family at sa mga mahal natin. In fact, we are often abused because of this innate nature in us. Anyway, that’s why the police like to to these raids in these kinds of establishments kasi alam nilang may pera tayo.

  39. lakan said on 20-04-2012

It is really unfortunate that these things still happen in our country. IMHO, Filipino policemen are one of the most IGNORANT and INEPT law enforcers in the world (still remember guys the Quirino hostage crisis and the suspect torture case?). I can’t believe over 94 million Pinoys are still being served by these kind of people. Countless of times you still see on TV everytime they handle arrests/raids, proper protocol is almost always being ignored. The government really needs to WAKE UP! And for all of you who are reading this right now: PLEASE, FOR YOUR OWN SAKE, KNOW YOUR RIGHTS ❗

I believe, hindi talaga dapat maglagay ang may ari dahil it’l be like tolerating them to do the same thing in the future which is violating human rights and getting rewarded financially in return. No one committed a crime and yet they are incriminating innocent people for it.

Just a few comments and observations of what I have read so far about the Club Bath incident.
    1. I don’t think it was the Paranaque Police that raided Club Bath. It was the Southern Police District Command of the PNP, which covers Pasay, Makati, Parañaque, Las Piñas, Muntinlupa, Taguig and municipality of Pateros. They took you to their Headquarters in Taguig. The jeep must have drove along the South Superhighway, then turned right to their Headquarters.

    2. Raids on Bath Houses, Sauna Baths and Bars are part of their regular extortion activities.

    3. Normally, there will be no uniformed officer during the raid. It is conducted purely by civilians accompanied by non-uniform officers, with no tags of identification.

    4. There is no police vehicle involved. Normally just a rented jeep.

    5. There is no court order or search warrant.

    6. The illegal raids are usually conducted on weekends between 11:00pm to 1:00 am.

    7. When such an illegal raid occurs, just keep calm. They will take videos to humiliate you. They will shout at you and even threaten that the media will soon arrive.

    8. They gather you in one area to determine how many jeepneys they would need to hire to bring you to their headquarters. Usually, there will be no official vehicles involved. If there is, they will stay clear from any participation in the raid.

    9. Keep calm, get to know their names and faces if you can. They will most likely take your phone and cameras away so you will not be able to take pictures of the raiders. Remember, during a raid, you do not know if the raiders have a search warrant or warrant of arrest. You also do not know if they are properly authorized. So keep calm first. The fact that you are with many other people is insurance or assurance that you would be physically safe.

    10. If the raiders make an arrest, they should bring you to the nearest police station. If not, that is a clue that the raiders are in it for the money.

    11. Once they bring you to their headquarters, things will settle down. This is when negotiations start. Again, keep calm.

    12. If you go to places like where raids are inevitable, then take the time to know some important things about criminal procedures, especially warrantless arrests.

    13. When they arrest you, they should tell you your Miranda Rights. They will have to tell you what you are being accused of. You have a basic right to a LAWYER OF YOUR CHOICE.

    14. Know your rights, know the procedures in criminal law. They are your best defenses. Google it on the net. Be sure it is specific to Philippine Law.

    15. Gone are the days when the raiders will threaten you with the charge of vagrancy. Most likely, they will threaten you with violation against RA 9208, which is the Anti Human Trafficking Act of 2003. Read this law well. They will say that the crime under this act is non-bailable to scare the shit out of you.

    16. In case you are charged with vagrancy, they cannot detain you for more than 12-18 hours. Same with Prostitution and Grave Scandal. If they charge you with indecent show, then they can hold you for as much as 36 hours.

    17. When you are in the station, find out if they have a court issued search warrant or arrest warrant. You should probably educate yourself on this aspect of criminal procedure as well.

    18. The most common mistake of raiders is that the officer enforcing the warrant is not authorized to do so. Find out by what authority the arresting officer is executing the warrant.

    19. Like I said, the raiders will not have the proper identification when they make the arrest. Most likely they will claim it is a warrantless arrest. Again, read the criminal procedures for a warrantless arrest.

    20. If the raid is legit, they will enter your arrest in their logbook. They will ask you to call your lawyer, even before they ask questions about you. Then, they will bring you to a medic for physical exam, just to ensure that when you were arrested, you were not harmed. With your lawyer present, they will bring you to a fiscal, and the fiscal will evaluate the evidence the arresting officer have before filing a case against you. This takes paperwork, which the arresting officers dislike.

    21. It pays to know your rights, but do you really want the hassle of going to court? Both sides actually don’t. That is where negotiations come in. The negotiations have to be completed before 6:00 to 7:00 am. Otherwise, the real bosses will be in and he will start asking questions. You must also realize that you can file charges against the arresting officers as well, if at anytime, your rights are violated.

    22. Human Trafficking is a very serious offense, but you must also remember that the law provides:

Section 6. Confidentiality. – At any stage of the investigation, prosecution and trial of an offense under this Act, law enforcement officers, prosecutors, judges, court personnel and medical practitioners, as well as parties to the case, shall recognize the right to privacy of the trafficked person and the accused. Towards this end, law enforcement officers, prosecutors and judges to whom the complaint has been referred may, whenever necessary to ensure a fair and impartial proceeding, and after considering all circumstances for the best interest of the parties, order a closed-door investigation, prosecution or trial. The name and personal circumstances of the trafficked person or of the accused, or any other information tending to establish their identities and such circumstances or information shall not be disclosed to the public.

In cases when prosecution or trial is conducted behind closed-doors, it shall be unlawful for any editor, publisher, and reporter or columnist in case of printed materials, announcer or producer in case of television and radio, producer and director of a film in case of the movie industry, or any person utilizing tri-media facilities or information technology to cause publicity of any case of trafficking in persons.

The TV Networks cannot shoot video footages of you. Nor can they broadcast the news about your arrest.

    23. My practical advise is they are all in it for the money. It’s your choice if you want to fight for your rights and do something about it. Then again, you have a job and reputation to protect. To the owners of Club Bath, it is also a business.

I hope that owners of these establishments take steps to protect their clients against these types of extortion. Keep your customers informed. Keep your employees informed on the proper procedure. If we have fire drills and earthquake drills, we should also provide drills on what to do when an illegal raid is conducted.

Here in the US, clubs like CB and Fahrenheit are considered and registered as PRIVATE CLUBS and dahil dun, hindi sila pwedeng pasukin ng mga pulis or any other parties kung walang warrant or permit. At the same time, mas open syempre ang US sa LGBT community so parang live and let live ang nangyayari.

Meron din ditong bar na kung saan sa loob ng bathroom, sa patio garden sa likod or even sa mismong pool tables eh anything goes. Minsan pa nga merong closed door orgy after bar hours. Yung garden area nila is always busy, merong nakaupo and smoking cigar while getting head, merong nakatuwad etc. Anything goes talaga. Once in a while, may pulis na nagche check if drugs are involved, yun ang bawal kasi. If you are curious to which place this is, it’s in Orlando Florida. If any of you are planning to go here in the coming days, I’d be glad to take you around.

I was there. I was the one who contacted AKBAYAN and TLF to help John look for a lawyer. It was already early morning, and all their contacts were out of town or asleep. Good thing, my contacts from the NGO where I came from had someone from the Commission on Human Rights to represent the detained and educate them of their rights.

Yes, there were violations. I saw it myself. The 70+ gaymen were shouted at, harassed and embarrassed to a point that some of them opted to privately talk with the officers and bribed their way out. I saw a total of five CB clients being escorted outside the camp as early as 2am. Unfortunately, for those who decided to wait for an absolution were made to stay until 5:45am.

The lawyer from the Commission on Human Rights talked to Team Leader of the arresting officers inside the office, while the 70+ who were detained stayed in a big nipa hut just outside the building. I moved around and tried to counsel those that were crying and were already thinking that they will be sent to prison until Wednesday the following week.

It is amazing, however, that the gay spirit still managed to uplift everyone up during those unsure hours. They found ways on how to make the other people laugh, or at least smile, despite being unsure of what will come next.

Yes, they were further oppressed came the wee hours of 5am. The Team Leader suddenly lost his temper and instructed his officers to put everyone in a big cell. It was a big cell, yes, but not big enough for 70+ people.

I saw them cry, beg, and ask to be released. I looked at the lawyer from the CHR and he told me that the officers were offended with his presence. Not to worry though, he said. They will not stop until a case is filed against them on what they did to these gaymen.

My friend from the NGO has informed me, that this is a common tactic by our Law Enforcements at this time of the year. Enrollment is just around the corner, and an easy way to get bribes is to blackmail people like us with the threat of losing their reputation and being labeled as immoral and gay.

I had a chat with an officer on duty that morning and was told that this is one of their Mission Line-up this quarter. So be wary. If you plan to go to a blue bar, be prepared. A blue bar is a PRIVATE PLACE. It’s not like a movie house or a park, where you can get arrested for public indecency. Know your rights. There is no law that says you can’t have sex with another man.

    Stay happy. Stay free.

You guys can file criminal case for arbitrary detention, administrative cases for grave misconduct and corruption, and even civil cases for damages over violation of constitutional rights against the arresting police officers. Firstly, the arrest was without warrant. Warrantless arrest of the patrons is not justified as no crime is being committed. It is true what has been stated earlier that there is no sodomy law in this country (law which makes it a crime for two men who engage in sexual intercourse). The arrest is therefore illegal. The humiliation and harrassment shown by the policemen during your detention is also unacceptable. Worst, they made a milking cow out of all of you, taking advantage of your desperate and fearsome situation . This corruption and discrimination against us cannot be borne. File the necessary action to make a statement and to fight for our rights and liberty!

No, bro. Having sex in a clubhouse is not a crime. Understand this. The likeliest felony that can be charged here is public scandal. The gravamen of the offesense is to display obscenity or commit indecent or immoral act in a PUBLIC place. A Clubhouse is a hardly a public place.

Another thing, the policemen have no business or reason to be inside the clubhouse, unless they are there also as patrons. Nope, the policemen are definitely not EXMPTED from the clutches of this one little thing known as the CONSTITUTION.

      • Baxter said on 21-04-2012

First time lang ito nangyari.
Sana mag-kaisa lahat and mga bading!

    1) it is typical of raids to be conducted on Fridays. Why you say? Fridays generate the most number of patrons specially for establishments that operate at night, but also because this ensures maximum harassment to attain maximum extortion potential. No processing and bails happen on Saturdays and Sundays, so you are automatically locked up til Monday when you can only then either post bail or have things settled. As a tip, Fridays are the most vulnerable to raids, so to lessen the risk of this horrifying event, you know what day to cross out.

    2) Paranaque Police does not have jurisdiction over Club Bath (which is located in Pasay). I’m guessing if the case were of a complaint filed by someone in Paranaque or involved an offender resident of Paranaque or that crime was committed in Paranaque but the offender was pursued all the way to Pasay perhaps it may be warranted. In any case, Paranaque Police will not mount any operation outside its territory unless it has notified or coordinated with Pasay Police. And we know that in this case Club Bath has for decades been under protection of Pasay, otherwise it might cease to exist legally… Which now makes this “quasi raid” a bit “out of order” to say the least.

When the Ms. Universe Pageant opened their doors for transsexuals, I’m actually one of the people who disagreed at that moment because I believe that “a man can never become a woman until it is medically possible for him to have the ability to bear a child”. But then something like this RAID happens. It now reminded me why our people keep on trying to persist and “REPRESENT” at venues/mediums where we are not unanimously wanted.

The ignorant question of the policeman in this article got embossed in my mind. If only there’s a way for me to sit down with him w/ a cup of coffee or a couple of beers and enjoy answering his question, I would answer “Bakit ako maiilang?, It feels so good?!.. if you had sex with a girl, it’s something like that except without the natural lubrication but more intense.. Believe me, once you try it, you will absolutely love it! :-)… Wanna try?”.( HAhaha, sounds so slutty but I don’t think those words would even cross my mind standing in front of policeman who’s trying to persecute me.. well, unless, he’s really good looking which I doubt, then there’s a great chance that he would actually be curious. LOL! 😆 ) But then, for me to have that opportunity to educate some one of authority who’s that narrow minded is quite rare and almost impossible.

Now back to Miss Universe, as much as a transsexual defies a pageant tradition that’s a half a century old. It will create huge leaps and bounds for our people who have been fighting for centuries to be accepted with no questions asked. In my opinion, he’s a man who had surgery that made him look like a woman but his DNA still says that he’s a man w/ an XY chromosome. But if this would help the rest of the world understand LGBTs and change the norms and destroy social Taboos against us in the “Filipino Culture” or any other culture all over the world, then I’m in. Better yet, if that could change the mind or at least affect the conscience of that one heartless policeman then we have just made a huge step in making our world a better place. 😐

Don’t you think these raids “unintentionally” happen during paydays?

as far as I know, assault at police brutality ang ginawa ng mga pulis kasi wala naman talagang nakasulat sa batas na bawal ang pakikipagtalik ng lalake sa lalake. ang problema lang kasi ay hindi lahat alam ito.

    Dear Vic

oh my… Hope to hear from you Vic.
